Flavio Briatore, the executive advisor of Alpine in Formula 1, has ignited a major controversy at the Italian Grand Prix. He made statements questioning the independence of a judge on the FIA International Court of Appeal. The remarks followed the court's decision to reinstate two five-second penalties for Pierre Gasly, costing him a podium at Monaco.
Briatore's Claims and the McLaren Connection
During a press conference, Briatore claimed he accepted the ruling but highlighted the behavior of judge Filippo Marchino, calling him "very nasty" and acting "like a prosecutor." He even alleged Marchino has close ties to McLaren, one of the teams that had appealed the initial decision favoring Gasly.
The statement immediately drew reactions. McLaren and Red Bull were the two teams that appealed, making the alleged connection highly sensitive. Briatore read his remarks from a piece of paper, underlining the gravity of the issue he raised.
FIA's Firm Response: Process Independent and Compliant
The FIA International Court of Appeal issued an official statement on Saturday morning, asserting that the appointment and participation of judges in this case followed applicable FIA procedures. All judges are elected by the FIA General Assemblies, some proposed by F1 teams, and they are subject to independence and confidentiality requirements.
The court emphasized that judges make annual disclosures of interests and sign a declaration of independence for each case. With a roster of 36 leading legal experts, at least eight are selected for each case, and this pool is communicated to involved parties in advance. This ensures there are no serious and objective reasons for recusal due to conflicts of interest.
FIA's statement serves as a strong rebuke to Briatore's claims, reaffirming their commitment to the highest standards, including IBA guidelines on conflicts of interest. Thus, the controversial appeals process is deemed transparent and independent.
